Official Native Art Contest Rules and Prizes

2. Eligibility: The purpose of this Native American Art Contest (aka Contest, or Native Art Contest) is to acquire photos of Native landscapes or photos of authentic Native-made art forms for use by PWNA, in alignment with our mission. Accordingly, contest entry is restricted to photos as described in Method of Entry below. All PWNA Facebook followers are eligible to cast a vote for the winning selection in the Contest on the PWNA website. This Native American Art Contest is open to all U.S. residents, who as of the contest date are at least 18 years of age, have a valid e-mail account, and a tribal ID card if submitting a Native-made art form. Employees of Partnership With Native Americans (PWNA) and the immediate family members of, and any person domiciled with such employees, are not eligible to submit entries or vote on the Contest winner. Partnership With Native Americans is not responsible for contest form failures or errors in any promotional graphics or advertisements. Winner must be in compliance with all contest rules. This promotion is in no way sponsored, endorsed or administered by or associated with Facebook.

3. Method of Entry: The Native Art Contest period begins March 15, 2019 and ends April 30, 2019, following which time one (1) prize will be announced on PWNA’s Facebook page at www.facebook.com/PWNA4hope. Each contestant must include a valid e-mail address, and a copy of your tribal ID card if you are submitting a photo of a Native-made art form. Enter only once for the Contest. No donation is necessary to enter or win. Upload your digital photo no later than midnight Eastern on April 30, 2019.

Two entry methods are available: 1) registering and submitting a digital photo that you took and own all rights to, and that meets the photo specifications outlined below; or 2) registering and submitting an image of your tribal ID and a digital photo of any Native-made art form you created and own all rights to, and that meets the image specifications outlined below.

The Registration Form (right) must be completed online. Contestants must complete all fields and information requested on the online registration form. In addition, your digital submission must be uploaded at www.hightail.com or www.sendthisfile.com.

  • If uploading at Hightail, you need to create a Hightail account, click on Start Sending Files, address the email to webmaster@nativepartnership.org and upload digital photo and if needed a photo of your Tribal ID, click on Get a Download receipt, then hit Send.
  • If uploading at sendthisfile, you need to create a sendthisfile account, login, click on Send, address the email to webmaster@nativepartnership.org, upload your photo and if needed a photo of your Tribal ID, and click Send.
Do not attempt to submit your image through regular email, as the file size will be too large.

Digital Image Specifications: Any digital image submitted for the Contest must meet all the following specifications (any other submissions will be disqualified — no exceptions):

  • File Format: .jpg (jpeg)
  • Resolution: 300 dpi (dots per inch) at 100%. Tip: When taking the digital image, ensure your camera is set to the highest resolution possible and check your outcome. Digital images with resolution lower than 300 dpi at 100% will be disqualified.
  • Size: Horizontal image 24 inches wide by 16 inches high. (Vertical images 16 wide by 24 high will be disqualified.)
  • Bleed: Leave one-half inch safety zone around all four edges as the printed version will be reduced and trimmed to meet PWNA’s needs. In other words, anything critically important to the image should not be on the edges.
  • Open space: The image should not be overcrowded and must have some open area where we can add our report name or message and PWNA logo.
  • Subject matter: For digital photos, PWNA accepts subject matter related to reservation landscapes in South Dakota, North Dakota, Montana, Wyoming, Arizona, New Mexico and/or Utah. For digital photos of any Native-made art form that you created, PWNA accepts subject matter related to jewelry, pottery, basketry, beadwork, feathers, dreamcatchers, or other Native items that you made. Images featuring “real” people will not qualify because of legal requirements for permissions and reproduction. The one exception is if the contestant creates a painting that portrays a “real” person; in this case, only the contestant’s permission is required for reproduction.
  • If you have upload issues, please message us on Facebook and we will respond quickly.

4. Ownership: Ownership: Entries submitted in this Contest should not already have been used in other promotions or committed to other entities for any use, whether online or offline. Contestants must have sole ownership rights to the image used for Contest entry. By submitting an image for Contest entry, the contestant warrants and represents that he/she consents to the use of the image in print and to its posting on the Internet (including social media outlets) in connection with the Contest and other marketing by PWNA.

By entering the Contest, each contestant agrees that PWNA and its affiliates may publish his or her digital image in the 2018 Annual Report, Native Art Contest promotions, and other marketing materials, with credits to the Contestant; make derivative works from or otherwise use his or her digital image entry and other entry materials for any purpose in any media, in perpetuity, without limitation or additional permission or compensation beyond the Native Art Contest prize described in these rules, except where prohibited by law. This includes exclusive rights to worldwide publication for the period up to publication of the 2018 Annual Report by PWNA.

PWNA retains sole discretion to determine if an existing agreement represents a conflict), and to disqualify the image entry from the Contest if needed.

5. Deadline for Receipt of Entries: Contest entry closes immediately after midnight EST on April 30, 2019. Entries submitted after that time will not be eligible for the Contest.

6. Selection of Winner: PWNA will review all qualified entries, narrow them down to the top six (6) images, and display them to its Facebook followers for a final vote via PWNA's website to determine the winning entry for the Native Art Contest. The voting will take place from 9 AM Eastern to Midnight Eastern on Wednesday, May 1, 2019 and the sole winner of the Native Art Contest will be announced on the PWNA4hope Facebook page and the PWNA voting page the next day. Odds of winning depend upon the number of entrants.

7. Prize: The Native Art Contest is a chance to be recognized and have your work seen by thousands of people. One (1) winner will receive the following prize and promotional benefits:

  • A prepaid Amazon gift card valued at $200 retail, plus cost of shipping it to you.
  • An article on the PWNA blog profiling the artist and their winning image, and related promotion by PWNA on social media
  • Artist credits on the cover of the 2018 Annual Report, and print and digital copies of the report for the artist’s portfolio or gallery

8. Winner Notification and Acceptance: Winner of the Native Art Contest will be announced on the PWNA4Hope Facebook page by 5 PM Eastern on May 2, 2019 and based on the one-time entry call to action for the Contest. If the winner has not accepted their prize, they will be emailed no later than May 6, 2019 for a final chance to claim it. Participants grant Partnership With Native Americans the right to use their name and digital image in advertising and promoting the contest without further compensation, and to further use the image in their annual report and other content.

9. Participation: All decisions regarding disqualification of entries shall be at the sole discretion of Partnership With Native Americans. PWNA is not liable for lost, late, delayed, damaged, or incomplete email or transactions, for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Partnership With Native Americans. In the event of a dispute, each entry will be deemed to have been submitted by the owner of the email account that was registered for the Native Art Contest. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account. PWNA is not responsible for any liability pertaining to copyright violation.

10. Limitations of Liability/Disputes: By entering the Native Art Contest, entrant agrees that all disputes, claims, and causes of action arising out of or in connection with the contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; any claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the contest, but in no event attorney’s fees and under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages other than damages for actual out of pocket expenses. Winner(s) will be responsible for any taxes on the value of the prize. THIS CONTEST IS GOVERNED BY THE LAWS OF THE UNITED STATES AND THE STATE OF TEXAS, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES.

11. Construction: All issues and questions concerning the construction, validity, interpretation, and enforceability of these official contest rules, or the rights and obligations of any contestant and Partnership With Native Americans, shall be governed by, and construed in accordance with the laws of the state of Texas, without giving effect to any choice of laws or conflict of law rules or provisions that would cause the application the laws of any jurisdiction other than Texas. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provisions were not contained therein.

12. General Release: By entering the Native Art Contest, contestants release Partnership With Native Americans and their affiliated companies and agents from any liability whatsoever for any claims, costs, injuries, losses or damage of any kind whatsoever arising out of or in connection with the Contest or with the acceptance or possession of any prize (including, without limitation, claims, costs, injuries, losses, or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light).

13. Sponsor: The Contest is sponsored by Partnership With Native Americans, whose decisions regarding the selection of winner and all other aspects of the Contest shall be final and binding in all respects. Partnership With Native Americans will not be responsible for typographical, printing or other inadvertent errors in these Official Contest Rules or in other materials related to the Contest.
